Contracting/Maintenance Trade License Renewal in Dubai

To renew Contracting/Maintenance related licenses, the following procedures to be completed at Dubai Municipality.

• Type License renewal form of Economic Department (DED) and submit at the counter to get Transaction number.

• Fill application of Dubai Municipality. The following documents are required:

• Copy of Trade License

• RTA statement stating the details of vehicles. To get vehicle list from RTA, a request letter in Arabic should be prepared in company letterhead with seal and signature. Fee: Dh60. Go to any RTA Customer Care Centre office to get Vehicle List.

• Tenancy contract of office and Labour Camp.

• Labour Camp report issued from Ministry of Labour (If camp is outside UAE).

• Employee List printed from Labour website.

• Company comprehensive report from Ministry of Labour (This report can be collected from any branch of the Ministry of Labour).

• Approved Engineer's Passport copy with visa page, attested Educational certificate, one photograph and copy of Society of Engineers membership.

• Engineer's pass certificate from Dubai Municipality or date of pass.

• If the requirements are fulfilled, application will be approved within 3-4 working days. Municipality will charge for each Engineer/Technical Staff. After doing payment approval will be updated  to the applicant and to Economic Department. This print has to be attached with DED application form and to be deposited at DED submission box along with previous transaction print and copy of Tenancy Contract for the license renewal process. 

• Payment Voucher will be ready in two working days and by paying we can collect the original renewed trade license.

Residence visa for a new born baby in Dubai.

Criteria

You must apply for a residency visa for a new-born baby within 120 days of his/her birth. If you fail to do this the child will not be allowed to leave the UAE and the legal guardian must pay an AED100 fine for each day over the 120 day period.

Documents Required:

• Application form

• Original passport for the baby (if the baby was added to one of his parent’s passport, take that one)

• Original + a copy of the baby’s birth certificate (must be attested by the Ministry of Foreign Affairs - Dubai office. 

• 3 passport sized photos of the baby

• Original + a copy of the attested marriage certificate

• Passport copy of sponsor.

• Copy of job contract for the sponsor or a salary certificate

Merger of a foreign Branch/ Representative office

Definition of 'Merger'

                “A merger or acquisition is a combination of two companies where one corporation is completely absorbed by another corporation.”

       4. True copy of company’s memorandum / articles of association of parent company (Legally Translated in Arabic and Attested)

       5. Board Resolution for appointing a Director / Representative for the UAE Branch with all powers to sign and act on behalf of the parent company (Legally Translated in Arabic and Attested)

      6. Auditors Report – At least for last 2 years

      7. Power of Attorney to the Representative / Director

CONTRACTING LICENSE REGISTRATION AT DUBAI MUNICIPALITY.

To register a new Contracting License, the following procedures to be completed at Dubai Municipality through online.

List of activities controlled by Dubai Municipality.

• Type initial approval form of Economic Department (DED) and submit at the counter to   getTransaction number. 

• Fill online application of Dubai Municipality.

Documents Required for Submission.

• Copy of Naturalization book/Jinsiya for UAE nationals.

• Copy of passports (of the licensees + partners + manager) with residence visa page or copy of Visit/Tourist Visa).

• Copy of valid initial approval issued by Dept. of Economic Development (Activity + Partners + Trade Name). 

• NOC from the sponsor for expatriate partners.  

Note: No need NOC for Visit and Tourist visa holders. Visit visa holder can change status inside country. But Tourist visa holder must exit and enter again to get Investor/Employment visa.

• If the requirements are fulfilled, online application will be approved within 3 working days.

Approval will be sent online to the applicant and to Economic Department. This print has to be attached with DED application form and to be submitted at  DED counter along with other documents.

DUBAI FISHING LICENSES FOR RESIDENTS ONLY

 Individuals who want to go fishing must obtain a license from the municipality for recreational fishing — whether it is along the coastline or in leisure boats.

Expatriates who wish to go for recreational fishing in Dubai must be residing in Dubai.

"A fishing license is a requirement for individuals prior to conducting [any] fishing activity. The fishing license will be given only to those who have their residency visa issued in Dubai and are living in Dubai," no fishing license would be issued to those who have their visas issued from another emirate and are living in another emirate. Even if the residency visa is issued in Dubai no fishing license will be given if the person is living in another emirate.

Equal conditions

The same law is followed across other emirates, adding that Emiratis who have their passports issued from Dubai can fish in Dubai.

"If people have their residency visa issued from another emirate they must be living in Dubai to be given fishing license from Dubai. They must prove to us that they are living in Dubai, those who caught fishing without a license will be fined.

Fishing is only allowed in specific areas as authorized by Dubai Municipality. "This is to ensure the management of fishing operation and strict implementation of the Federal Law No. 23 of 1999 on the Exploitation, Protection and Development of Aquatic Resources in UAE and the Federal Law No. 24 of 1999 for the Protection and Development of Environment."

Setting up of Branch of a Free Zone Company In Mainland

The only legal alternative for Free Zone Companies wishing to carry on business in the UAE is to appoint a mainland UAE agent or to establish a mainland branch of the Free Zone Company. In both cases the local UAE agent must be a UAE national or a company wholly owned by UAE nationals. 

Both options present practical difficulties and additional expense for Free Zone entities wishing to enter the UAE marketplace.

A branch company or local agent may carry out services or sell goods on behalf of the Free Zone Company, this can be a costly and, particularly in the case of service providers, where human capital is involved, an impractical and difficult model to operate.

SHARJAH AIRPORT FREE ZONE ( SAIF ZONE) COMPANY FORMATION

SAIF ZONE

Company registration

To operate from within the SAIF-Zone, a company has to be incorporated. The Legal Status of the companies in SAIF-Zone is classified as here under.

1. Free Zone Company (F.Z.C)

Two or more legally capable persons natural or juridical can establish a Free Zone Company in SAIF-Zone with a minimum capital of AED.150, 000/- or its equivalent in US Dollars. In normal cases the maximum number of shareholders is up to 5 and if approved by the SAIF-Zone management the maximum number of shareholders can go up to 7 shareholders. Liability shall be limited to the FZC's share capital.

2. Free Zone Establishment (F.Z.E)

A legally capable person natural or juridical can establish a Free Zone Establishment in SAIF-Zone. In other words there shall be only one owner (shareholder) in a Free Zone Establishment. The minimum amount of capital required is AED.150, 000/- or its equivalent in US Dollars. Liability shall be limited to the FZE's share capital

IMMIGRATION BAN IN UAE

With the exception of UAE nationals, all other residents require permission from the UAE government to live in UAE. All non-Emirati require work permits to be employed in Dubai and UAE. They may be subjected to a work visa or entry visa. Ban depending on who they are and what they had been doing when in Dubai or UAE. 

An immigration ban means you cannot enter the UAE, whether as a visitor or for residency. Other bans can arise if you have been convicted of a criminal offence while in the UAE. Common offences that many expats get into trouble with are bad debts, bounced checks, drinking and driving, drunk in public, inappropriate relationships. Of course, more severe offences such as theft, violence, rape, murder etc will also result in an immigration ban but not so many expats indulge in these activities, and those that do are not usually so surprised to receive a ban.

An immigration ban can also arise if you have broken the rules related to immigration for example entering the country illegally, working without a work permit, absconding (leaving your job without informing your sponsor / employer), overstaying (this last one is not so likely to be a problem, just expensive when you get your overstaying fine)

Criminal offences usually result in a permanent ban and this is monitored via eye-scanning equipment at airports, so losing your passport and getting a new one won't get you back in to the country.

EXPATRIATES NEED MISSION VISAS FOR SHORT- TERM JOBS

"Mission visa is valid for entering the country for 60 days and the holder of such visas can stay up to 90 days after entering the UAE. This kind of visa is renewable once for another period of 90 days after which expatriates on mission visas has to leave the country”

Dubai: While people on visit visa are not allowed to work with or without salary in the UAE, expats who wish to work for a short time or on probation can enter the country on mission visa which is for 90 days, according to a senior official.

People who enter the country on visit, transit and tourism visas cannot work and cannot obtain a work permit here

People caught working on visit visas will be deported and banned from entering the UAE forever and employers will be fined Dh50, 000 for each such worker, according to him.

Expatriates on visit visas cannot obtain work permits within the duration of their visas and those who come on visit visa to look for a job must leave the country once they find a job after which visas can be processed as per rules for employment visas. People hoping to work here from the date of their arrival must arrange for an employment visa before coming here.

"The employment visa allows people to enter the country once and is valid for 30 days, during which the employer should complete the processing of their work permits and residency visas,"

Sponsoring company

Mission visa can be applied for at the Ministry of Labor by the sponsoring company. Ministry also issues a temporary work permit which is different from the mission visa.

People who enter the country on mission visas need to obtain the mission card from Ministry of Labor. People on mission visa can convert it to work permit and continue to work. Temporary work permit is also issued for those already living in the UAE on residence visas on case-by-case basis.
